You should consider the following:
- In order for you to comply with your legal responsibilities described in Regulation 6 of the Privacy and Electronic Communications (EC Directive) Regulations 2003 as well as the Data Protection Act 1998, if your website uses cookies (or similar technologies), you need your user’s consent. To attain this, you should have a cookie warning message on your site (which can be implied e.g. “your continued use of the site means you accept our use of cookies” i.e. the user’s consent does not need the user to actively accept or tick a box).
- In addition to attaining consent, you also need to inform the user of what cookies are used and provide them with the reason for their use i.e. their purpose (and any other key information) so ask your web developer to do a cookie audit and then have that information populated in to the table provided in the template.
- If your website does not use cookies, you will not need a cookies policy.
